Will of John Henry and Eliza Preas - 1906


 

                                          J. H. Preas and E. S. Preas               WILL

 

                                   The State Of Texas, County of Delta

 

                I, J. H. Preas of said county and State being of sound and disposing mind and memory and being desirous to

        settle my worldly affairs while I have strength so to do, do make this my last will and testament hereby revoking all

        others heretofore by me made.  I give and bequeath to my beloved wife E. S. Preas, all the property that I now own

        both real and personal or may accumulate so long as we both shall live, together with all and singular the rights and

        appurtenances to the same in any way belonging free from all charges or limitations whatever in fee simple to dispose

        of as she may wish, and I, E. S. Preas, wife of J. H. Preas being of sound and disposing mind and memory and being

        desirous to settle my worldly affairs while I have strength so to do, do make this my last will and testament hereby

        revoking all others heretofore by me made.  I give and bequeath to my beloved husband, J. H. Preas, all the property

        both real and personal that I now own or may acquire so long as we both shall live, together with all and singular the

        rights and appurtenances to the same in any manner belonging free from all charges or limitation whatever in fee simple

        to dispose of as he may wish, and we J. H. Preas and E. S. Preas hereby bind our heirs executors and administrators

        to warrant and defend the title to any conveyance that whichever one of us survive the other shall make and that the

        survivor shall own in fee simple all the property both real and personal that we may make during our natural lives

        together with all and singular the rights and appurtenances to the same in any manner belonging free from all charges

        or limitations whatever in fee simple to dispose of as he or she may wish after our estate therein is our we hereby appoint

        our son J. W. Preas should he survive us guardian of both the person and property of our minor children to act without

        bond and if he should not survive us both we appoint J. B. Preas to act the same manner that we empower him also

        without bond.

 

        We require that all of our possessions be equally divided among all of our children that one shall not have more than

        another and J. W. Preas or J. B. Preas whichever one acts as guardian of the person and estate of our minor children,

        shall see that everything is equally divided among all of our heirs.

                The State of Texas, County of Delta

        Before me, J. M. Frith, J. P. and ex officio N. P. in and for Delta County Texas on this day personally appeared

        J. H. Preas and Eliza Preas known to me to be the person whose names are subscribed to the foregoing instrument

        and acknowledged to me that they executed the same for the purposes and considerations therein expressed, and

        the said Eliza Preas wife of the said J. H. Preas having been examined by me privily and apart from her husband and

        having the same by me fully explained to her she the said Eliza Preas acknowledged such instrument to be her act and

        deed and she declared that she had willingly signed the same for the purposes and considerations therein expressed,

        and that she did not wish to retract it.
