__________, sister, age 53, born September 1842 in TN Mahala had a difficult time establishing her right to a widow's pension because she could not initially establish herself as the legal widow of the soldier. Mahala had been married prior to her marriage to Richard. In 1864 she and Wesley Wyrick were married by a justice of the peace in Hawkins County. They lived together as husband and wife for 11 days, when Wesley enlisted in the Union Army. After his discharge in 1865, Wesley married Happy Arnold, whom he deserted in 1876. He married for the third time in 1877 and died of accidental causes in 1882.
Initially Mahala tried to take the position that her marriage to Wesley had been a fraud or a mock marriage and created no impediment to her marriage to Richard Viles. She later stated that she thought that once Wesley remarried, she was free to remarry as well.
Eventually it was decided that once Wesley died in 1882, Mahala and Richard established a common law marriage and that she was entitled to receive pension benefits based on Richard's Civil War service.
