Will - of Harry Gaines II of St. Stephen's Parish, of King & Queen Co., VA

Feb. 11, 1785

In the name of God amen, I Harry Gaines of the ____parish of Saint Stevens being of perfect mind and memory ___ last will and testament in manner and form following that it is my will and desire that all my just debts be faithfully and __ __ in a manner as possible and for that purpose it is my will that ___ mentioned should sell such of my personal estate as is in their ___and as may be sufficient for the purpose above mentioned. I desire that the land wherein I now live may be divided into two parts nearly as may be an equal proportion of flat land and hills___at the same time the dividing line does not in any part thereof ___two hundred and fifty yards of the dwelling the part that the said dwelling___I give to my loving wife during her natural life and no longer and the ___I desire shall be kept to work by my son Robt Beverly Gaines __ Gaines' negroe's on untill Robt Beverly Gaines's arrives to (maturity ?) years or marrys for the mutual and reciprocal support __ of my said two sons Robt. Beverly Gaines and William Fleming Gaines. __ nonetheless if my loving wife should depart this life before __ __ __ to the age of twenty-one years or marrys than and in that __ __ whole of the above mentioned tract of land whereon I now live __ __ as sonn as possible equally divided between my tow above mentioned sons, Robert Beverly Gaines and Wm. Fleming Gaines them and their heirs forever. __ Robert Beverly should arrive to the age of twenty one years or marry __ then I give him the parcel of land above mentioned (which __ support of the two brothers) to him and his heirs forever and upon the death of my loving wife I give and bequeath to my son William Fleming Gaines and his heirs forever.

I lend unto my loving wife one third __ __ during her natural life and after her death my will is that they distribute (?) among all my children them and their heirs forever.

Item:: I give the tract of land commonly called the Bestlands to my two sons William Fleming Gaines and Robert Beverly Gaines, to be equally divided between them and their heirs forever __ __ and bequeath my four tracts of land which I have in the country __ __ officers and soldiers of the Virginia line to my four sons that is to say, one thousand acres to my son, Benjamin Gaines, to him and his heirs forever, one thousand acres to my son Harry Gaines to him and his heirs forever and one thousand acres to my son Robert B. Gaines to mim and his heirs forever and one other tract of a thousand acres to my son Wm Fleming Gaines to and his heirs forever; and whereas I expect there may be a great difference in the quality of he several tracts of back land above mentioned and whereas it is my desire that all my sons may have equal justice it is my will that they draw lots for the choice of said tracts.

Item:: I give and bequeath all my lotts in Hanover Town and my small tract of land in this County lying on Mattapony River containing about sixty three acres to my daughter Martha Gaines to her and her heirs forever.

Item: I give and bequeath my two negroes little Harry and Sally to my son Harry Gaines to him and his heirs forever. I give and bequeath my two negroes Cato and Maria to my son Robert Beverly Gaines to him and his heirs forever; Item: I give and bequeath my two negroes ____ and Hetty to my son Wm Fleming Gaines to him and his heirs forever; Item: I give and bequeath my two negroes James and Aggy to my daughter Martha Gaines to her and her heirs forever; Item: It's my will and desire that all my estate of what nature soever either real or personal that is not herein before mentioned shall be equally divided among all my children and do hereby appoint my very good friends Larkin Smith and John Garlick and my beloved wife Executors to this my last will and testament hoping that they will all qualifie as such and pay particular attention to the education of my children. I do hereby certifie that this my last will is written with my own hand, and the interlinations made before signing: In witness whereof I have hereunto set my hand and affixed my seal this 11th day of February 1785. Harry Gaines."
